The Importance of Neutrality and Being Objective in Investigations

In a recent B.C. Supreme Court decision [Vernon v. British Columbia (Liquor Distribution Branch), 2012 BCSC 133], an employer learned a costly lesson about the need for unbiased, neutral and objective workplace investigations. A thirty-year employee of the B.C. Liquor Distribution Branch was the subject of a complaint by one of her direct reports alleging harassment, intimidation and threats. The accused party in this case had a clean disciplinary record with above average performance reviews, but was known to be somewhat abrasive in her management approach.
